You will need this form along with a strong letter of hardship explaining your circumstances. The letter of hardship is the most important piece of information in the eyes of the lender / bank and it better be valid and truthful.

  1. I filled out these forms OVER AND OVER again…I have been waiting since November 2008 for help! I can call Chase one day and ask if I was approved for modification and be told "yes" then call again the next day and be told they are missing paperwork and that they have not approved us. I have e-mails from Chase saying I was approved, yet I get collector calls saying they are starting forclosure and I was denied! IT IS UNREAL! They put us in a "3 month" trial program 4/2009. It is now 2/2010 and we are still WAITING! During the trial period, you pay a reduced rate (per a WRITTEN agreement w/Chase) You may not miss a payment or be late. We did everything they asked. Chase has now lopped about $8000 in fees on my mortgage and in order to keep our home they want all that BACK! During the past 10 months they have reported our payments LATE to the credit bureau. (again, they were never late) How is this legal? Can I start a class action suit?? So now I am looking at our family of five losing our home and we never missed a PAYMENT…plus our credit is ruined from the "help" Chase gave us. How can we even get another home? This is just disgusting!

    • In april this year (2010) its will be a year, that I've been doing the same dance with chase. My trial period ends april too. I have 1 more scheduled trail payment left. After which I am going to stop and let them take the property. I've been told every excuse in the book by chase and it's a big fn joke. They dont want to help they just want to keep taking our money. Just like you said my credit is ruined now. So im just going to end up walking.

      We came up with the conclusion that…chase is not in the business of helping any of their cuurent customers. They are a disgrace to our society and any foundation or perception of helping anyone. They are an evil institution and thats how their owners from the European nation wants it.The people are going to lose their mind if they think is going to assist them.People get a clue chase is not owned by U S interest, they are owned by foreigners who want the U S public to be in turmoil and debt to them until death. God Help US.

    • If anyone starts an civil action lawsuite I am in.. I have read all these statements and it is what I am going through as well.. This has to stop and it will take all of us to form a union to do it.

      • This is the same story all over. How is it that we are not protected against a giant like Chase? Didn’t the government try to bail them out of trouble? Now, our credit is so ruined that we cannot go to another lender. What a pity? if there a suit, count us in.

    • This is just unbelievable. I have done the same! I have sent paperwork left & right, have paid with their “trial” payments. Everything they’ve asked for! but apparently “paperwork expires” and I find myself sending all this paperwork over and over again just to find out my house was foreclosed on and now they’ve decided to postpone the “eviction date” because of the so many lawsuits against this horrible bank due to a high degree of skepticism when processing the paperwork by robo-signers. I just truly hope the inept unsensitive people that work there don’t have to go through the same year longing torturing feel that they’re gonna loose their home! Just sick!!!     • I have been going thru the EXACT same thing since Jan of 09. Your letter sounded just like one I fax to Chase every week. …with no reply of course. I am at wits end and am afraid of losing my house due to their stupid mistakes and incompetence. Chase sucks!

    • The same thing happened to me…They told me I would qualify for the modification and then told me I didnt make enough money to qualify. That doesnt make any sense to me. If I made more money, I wouldnt be asking for help! I keep getting forclosure notices, and they keep sending me modification packages, but why go thru the headache again when they are going to deny me….I need to talk to someone that can help me…..I am in Maryland…any suggestions?

    • Chase really screwed me a year or so ago by calling me and telling me i was approved for a loan modification many months after i sent them a ton of paperwork. They told me that i was 99% assured that i would be approved after my 3 month trial period. Well 8 or so months later, while paying an amount less than my original mortage, they called me and told me that i owed them an enourmous sum of money and that i must pay right away or i would be foreclosed on. I paid the money and thought this was behind me until i tried to get a loan from my credit union and they laughed me out of the place by telling me i had been late with my mortage for the last 8 months. I called chase and complained bitterly and they said, “that was in the fine print” that you would be reported while in the “program” I echo what someone else said earlier, what can be done about this. I know it’s legal, but violates the spirit of operating in good faith and now my credit is screwed up for who knows how long solely because of this.

  2. yeah sane thing happened to us, keep saying they never got the paperwork, now we got foreclosure papers, which they say we we owe 5 months of paymentw which is total bull, we borrowed the money while they “research”, they are chaqrging an additional $1700 attorney fees which I sent $8500 certified funds to reinstate the lown and stop foreclosure b ecause they have lost payments and lied, today they said the address is wrong and have no idea where my certified check is, the reps are illiterate and rude, it doesn’t matter if you write who you talk to, they just lie, i will probably lose my home because of their stupidity and lies, this can’t be legal, you can’t even get their attorney’s to call you back, it
    s like they are trying to take my home. I wish I would have recorded these calls from the get go, I really don’t know how they can do this. ican’t afford an attorney, i have brought this loan current, even though it isn’t behind to save our home, tired of fighting. something has to be done about these people, i call them on a daily basis and they never note anything and now they have lost $8500 and it was sent where they told me to send it, this is a nightmare

    • Check to see if the Certified founds have been cashed by Chase. If not go to the bank and tell them the check has been lost. Reissue the check and FedEx it to them. Always keep a paper trail with this company. It is not Ok what they are doing. They are the servicer of the loan let?s see some service.

  3. I filled paperwork in Feb 2010 – I did not fax it into a fax number. I met with someone at a Chase Homeownership Center and made sure that they would not loose my documents that is because I had the representative submit them for me… this person told me that I would call a the number that is on the first page of the form one fills out for the application for the modification – by the way it has changed 5 times! … Seeing all these bad comments does not help my stress level. I have called weekly and each time they say it’s under review. Sometimes they transfer me to another department and verification starts all over again. Sometimes I get transferred to a computer that tells me ” I’m sorry I cannot process your call any further please hang up.” and then hangs up! There are idiots working there that only transfer you. Make sure you write down everyone’s name and department location and ask them for a number of the department that they are trying to transfer you to, or ask them to stay on the line until the other department is there. There are also very smart people working there. One person the last one I will be calling ever again – this last person told me to only contact the person at the homeownership center who originally sent the paperwork in for me…. So there you have it… I called this person again and this person is telling me that only someone in a legal department could touch my file (a department called L.E.E.) Whatever! Now I am waiting for this person to tell me more. You bet I am emailing daily and it is much easier to have an e-mail trail than have to write it down after or while saying it. Besides – I will never have to listen to the stupid music or be transferred into the VOID or have to tell yet again another person getting overpaid by chase I am sure they can’t answer my question and customer service there stinks!

  4. My mortgage payments keep getting lost in the mail and I am trying to catch up on my payments by paying $287 extra for 6 months. I have even called the post office to find out what is happening to my mailed payments. They state that it might be Chase’s payment processing center. According to the post office many payment centers have automatic machines that open mail and sometimes these machines malfunction and shred the documents.

  5. Been trying for modifacation for one year next month. I have fax the same papers time and time again,then they say they have everything they need and its in the underwriters hands.Guess what
    just got another letter wanting more paperwork.I plan on contacting somebody that cares and it won’t
    be with Chase Bank because you cannot speak to any one there of any importance. I have exhausted
    all my 401-k trying to keep my house and still nothing.It looks like I’m not the only one with these problems.Good luck to everyone else.

I HAVE MORE OR LESS THE SAME PROBLEM SINCE APRIL I BEEN TRYING TO DO A MODIFICATION ON MY HOUSE, I AM TWO MONTH BEHIND IN MY MORTGAGET, CHASE INSISTED THAT IS THREE, I GOT PROVED THAT IS NOT AND WENT I REQUEST FOR THEM TO SEND ME A BREAK DOWN OF ALL THE PAYMENTS THAT I HAD MADE SINCE FEBRUARY OF 2009, THEY DON’T ANSWERED OR REFUSE TO DO IT SAYING THAT IF THE SYSTEM SAYING THAT I OWN THREE MONTH THAT WHAT I OWN. I THEM CALL AND GOT CONNECTED TO A YOUND LADY FROM THE MODIFICATION DEPARTMEN NAME JENNIFER, AND SHE DID A REVIEW OVER THE PHONE, ABOUT MY SITUATION, AND TOLD ME THAT I QUALIFIED FOR A HOME MODIFICATIO, SHE EVEN TOLD ME WHAT DOCUMENTS I SHOULD SEND, AND I DID. I WENT TO STAPLE STORE AND FAXED PAYING $57. TO FAX THEM ALL THE DOCUMENTS THAT SHE ASK. AFTER THAT, SOMEONE BY THE NAME BRIAN CALL ME AND TOLD ME THAT IN ORDER FOR CHASE TO STOP THE FORCLOSURE, I NEED IT TO SEND BY MAY 30 2010 THE AMOUNT OF $1,500 SO THEY CAN GO AHEAD AND BEGGIN THE PROSESS OF THE MODIFICATION.     • Never give up! Must keep on fighting to the end you could just win. Make sure that you have a log of every stupid thing Chase has done over and over. File complaints with the O.C.C, B.B.B and your states Attorney Generals office. If it goes to court that will even give you more time.

      • I have experienced everything these other people have, and it just gets worse every day. Nothing seems to help, and I’m so stressed out I can’t stand it. What is the OCC? I know the BBB. What do you think they can do? Big Banks, big power. We’re just the ones who keep them in their seats.

    • i hate to say this but im thinking of giving up myself and wait for an investor to buy it cheap and buy it back i will have time to file backruptcy and get my credit better or just buy a new one without using chase ever again. ive been fighting with chase since april of 2009 they tell me im in the final process of being approved when i send paperwork i put at the bottom copy filed/date copy filled atty/ date that way they think you have a lawyer and when u send money to them do it through your post office where chase will have to sign for the letter and keep the stubs from the certified mail u send out. this way they cant say they lost it i also only send a certified check from my bank fifth third that way theres a trial to who cashed it. I hope i get approved i going to hold out till next year and see what happens. i love this house and my new husband ive only been with a year and a half has done a lot of improvements to the home which he said he will rip out if they foreclose on me GOOD LUCK CHASE EVER SELLING THIS HOUSE LOL (CONDEMED).

      • I had all those things and more described in the blogs above. I started the process in July of 08. I received a loan mod as of Dec. 08 and began making payments, they were aplly my payments to the old loan because it took them three months to “maintainance” the mod. Long, very long story short….they put my house into forclosure, I got it pulled out of forclosure. After almost losing my mind, and making phone calls everyday, it was more than a part time job, I did save my house. Partly because I refused to let them win a fight they were not playing fairly in….I hate that. If you play fair with me and win…good game. If you are not playing a fair game…than its game on!!! I did receive my final mod. in Aug. of 2010. Its even better than the first mod. they screwed up. 2.75% for 5 years and up one percent until it hits 5.75% for the duration of the loan. There are so many factors that played a part in my success its too much to put in print. I have put my home phone on other blogs and have actually helped a few through the process. We have been working on a mod with cahse for eighteen months im sure we have sent documents at least 50 times we have made three different sets of mod payments and completed them we have been told numerous times that we’re very close to being approved then last month we got a letter saying we didnt provide all the documents I told them today its obvious that they have been given marching orders to shit can as many mods as possible. A friend went through this with chase he finally filed chapter 11 and a judge crammed his mortgage down to an affordable payment. It cut his principle by more than a third I told chase that I’m going to do the same thing. I would gladly get involved in class action lawsuit we have a file 6 inches thick on these apparently bogus modifications plans offered by chase. My wife tripped over this website by accident today. Its full of stories exactly like ours has anybody noticed that the loss mitigation department is the same as the modification department it wasnt two months ago unraveling these morons would’nt be to hard. I like talking to a minimum wage employee who acts pissed. It sure is funny when they make it personal.

One of the reasons chase isnt forclosing on all these properties is timing if these supposed mods were all forclosed on right now it would fall in the loss column of their books which would affect share price or shareholders and profit. While its in limbo it artificially props up their revenue. They have kind of a dilemma they need the economy to rebound a little so they can forclose and make more money by taking our properties and sell them above todays value and the mortgage value. Heres the problem their in bed with the administration these morons would blow a wet dream so theres no way the economy is going to turn around with these idiots in charge. I predict in november when both houses fall in the election this will give a sign to small business [which employ 70 percent of the country] that there is hope. the economy will start to rebound interest rates will skyrocket and the forclosures will really gain momentum the banks wont be doing any modifications. they will be hedging their bets and taking everybodys property. thats where they will really make money until then all they have to do treadwater and pretend their making modifications to prop up their share value and keep these properties on the good side of the ledger.

  10. I cant believe what I am reading! I thought it was just me. a year ago I made 2 early mortgage payments to Chase. They kept telling me I never paid, but I did. Even my bank got on the phone to tell them that they took the money out of my account. After alot of research on my end, we discovered that Chase accidentally applied those early payments to my escrow account. Why they didnt catch the big escrow balance and realize it is beyond me. I asked what they could do about it and they said that they couldnt credit the payments to my principal and interest account because they were so diversly applied. They said they would fix the records to indicate that my account was current. Meanwhile, they start the forclosure process on me, as if they never spoke to me about the mistake they made. At one point., when I asked a supervisor where my money went, I was informed that they can do what they want with my money! Eventually, after writing a letter to thier lawyer, the court, Chase, and my lawyer, Chase decidied that they could only fix the issue by putting me in a trial payment plan and then modifying my loan. I would have been happy to keep paying my full mortgage and them wiping my record clean, but was told it was too late. I have been in the trial for almost a year, and strangely, though I pay ontime, the balance gets bigger and bigger. I am told that they cant locate my file and I need to resend documents on a regular basis. Once I got a call saying that thier financial supervisor personally flagged my file as 2 mos delinquent in trial payments, when I was 2 mos ahead. I informed them that I am not surprised that they made such a mistake because they have proven time and time again that no one there can count. I was told today that I have to reapply for the modification, start over AGAIN, or I will lose my home. What can we do about this!!!???

    • We are going through a similar “issue” with the Mortgage Assistance Program. Hoping (and praying) that the account is brought into good standing/current.

  11. I’m having the same problem with Chase for over a year now and still no help . My husband had been laid off since November5,2008. and we couldnt make it on unemployemnt for the winter so I called Chase home finance and asked if they could help us by giving us a Loan modification so we could afford our 800.00 a month payment because unemployment only gives u 300 a week and bills and food are more then that a month . Chase told me that they couldnt help me and we always was on time never had late fees. and Now we are so behind in our payments and 9,800 in past due late fees and I really need help and still not being able to get a loan modification .

  12. With all of the exact same problems, I went to the NACA event in February for help. Guess which bank didn’t show up on Saturday? Yes, Chase! While the other banks were helping people, Chase stayed away. I think it’s time we all got together. Help in great numbers. But we’re all over the country and separated. Anyone have any good ideas on what to do? I keep reading all this nonsense that “people aren’t taking advantage” of O’Bama’s modification programs. Well, it’s been 10 months that I’ve been faithfully making my trial payments, and now they tell me I don’t qualify because the government has a formula that we must qualify for. Help!!!!!!!!!! Is anyone out there who can fight this huge ugly monster called Chase????

  13. is there some type of law suit against Chase regarding their “Homeowner’s Assistance Program”? We’ve waited six months with no response. Resubmitted the paperwork and now we are receiving foreclosure notifications! We’ve decided to pay the specified amount in full (creating a lengthy paper trail). Is there truly a way out of Chase’s Assistance program OR are they just going to foreclose on us anyway? Please help.

Does anyone have any numbers to call to get someone who can really help…the Chase customer service, collections, loan modification and foreclosure lines are useless…I’ve been through them all over and over again.

  15. I’ll be damned. I was search online for the Chase Hardship Affidavit, which I’ll be filling out for the 5th or 6th time, and stumbled onto this site.

    Dealing with the same thing here for well over a year now. Made my “trial period” payments, told we were approved for loan mod. Then “oops, we don’t have all your paper work.” I keep sending docs and Chase never seems to be able to hang on to them. WTF? I’m all for getting together with a class action suit.

    The way Chase is treating people is ridiculous. I would imagine there are tens of thousands of people dealing with this issue from Chase.

    • I get a different story almost daily, They are missing this paper or that. Case Managers were changed or case manager was let go. Sent money in forms of checks and through the bank sight, all was returned. Was told that I could not pay any money until the modification was approved thorugh the underwriter. Now I was just told that I could send money per certified funds/western union. We have the money to pay, and are more than willing to pay double the amount, but for some reason they don’t want our money.

      We are half way through the original loan, I am wondering if they think that they can sell the house for double what we owe.

      We filed a chapter 13 over 8 years ago and was able to pay in off in 8 months. The computer system had a glitch and they put us, along with anyone ever in forecloser back into foreclosure. This cost my husband a big promotion and the move that we had been praying for.

      I hope that we can all get justification and the help that we need. Answers would be great.

  16. Suggestion : email and continually contact your state representatives and congress people and ask them to file a claim with the Treasurers complaint office against Chase and for a file to be set up.
    Keep bugging your government representatives to look into it.

    Chimicles & Tikellis is investigating a potential class action lawsuit against JP Morgan Chase related to deceptive foreclosure and/or loan modification practices.   18. It’s been JUNE 2008 …. BUSH ADMINISTRATION…… what a joke Chase/EMC mortgage is. They get all the bail out money so in reality our loans have been paid off by whom? WE THE PEOPLE…… we should pay the federal government not Chase/EMC. We had an offer for modification Sept. 2008 with 2 days to sign, would not negotiate, not talk nothing just sign or forget it. we got an attorney who helped with a forbearance then a trial period that went from July 2009 to April 18, 2010 ( A VERY long 3 MONTH TRIAL PERIOD) we then get the modification but with many questions and 10 days to sign.
    We signed the contract because in section (K) states that the modification would be changed if errors are revealed. I sent a letter NOTIFIED them that there are serious questions….. additional $15,000 tact on with no explanation, the payment is $280.00 per month higher than the Trial Period Payment, the interest rate changes after 5 years from 5.00% TO 5.25% with the statement ( interest rate will adjust periodically) what the HELL does that MEAN. They could change to every month, week day to whatever they wanted, the HAMP loan is to be a FIXED rate from 2% – 6%. After making our payment for 2 month, i kept calling every week about the info requested and why the payment was not deducted automatically as stipulated with HAMP contract. My July 2010 payment I was forced to pay an additional $303.00 in late fee? The Loan Modification customer services girl told me ?please don’t get mad —- the notes state … THE LOAN IS STAIL DATED AND RETURNED TO THE UNDERWRITER TO RESUBMIT THE LOAN” she gave me every Managers name etc. I was told from the underwriter/manager that since I wrote the letter they felt we did not want the loan, therefore they now want $19,000 in balance owing 30 days and foreclosure will start and will be ramped up. Needless to say i LOST it.
    My husband spoke with them, the underwriter had been fired earlier that morning (convenient) they are willing to START THE PROCESS ALL OVER AGAIN !!!! THE TRIAL PERIOD request papers came the day after the foreclosure papers. Due to them August 20, 2010.
    I have been doing a lot of research on the MAKING HOME AFFORDABLE.GOV they have revamped the process to make the lenders more accountable, let’s see. I have filed a complaint with SigTarp for predatory lending. Secretary Geisner is the person we all need to write letters to via email or mail, hour after hour keep sending the same email to overflow his box. Maybe then he would get the picture.
    In all actuality the program is better now than when we started. My HAMP contract put us at 41% instead of the 31% that is REQUIRED! they now have the 2MP (2nd loan mod) and the Principle Reduction program (HPDP) Home Price Decline Protection, my house has dropped 53.55% in value since all this began, we also live in California and I am unemployed another program started Hardest hit Fund for 12 states and California is at the top.
    So as I start to reword my affidavit to include these 3 new programs and to spell out that my trial period payment is to be NO MORE THAN xxxx = 31% per the federal government. Let’s see if they get the picture. My payment will drop $664.00 per month from what the HAMP loan that we signed and they declined.
    I PLAN TO CRAM EVERY PENNY UP THERE ASS……… AND I HOPE THEY FEEL IT ALL THE WAY IN AND UP !!!!
    WE NEED A CLASS ACTION LAWSUIT

  19. So what is the answer? Has anyone worked out a mod with Chase? We are 1 and half years into this and they keep asking for more and keep giving us more fines. Do we just stop paying and give them the house? Has anyone even heard of someone working out a modification with Chase?

I have same question has anyone ever got a Mod apptoved by Chase min ehas been going on since 7/09 now i just get a denial letter statin because my 1st mtg is behind and not Modified they cant help me and now they want $4,000 to pay up to date all along taking 14 straight pmts and applying them as partial not full pmts ..has anyone tried to sue chase i thk they are doing unfair lending practices and they need to be reported tell me anyone did get a Mod approved how can it 14months and then they deny me cause my 1st is not modified and they dont reveal that upfront they say the mods chge monthly please

    • i hope the best for you im going through the same thing its been since april 2009 ive been fighting they say im in the final process but they want more paperwork faxed over have to wait because they said a transcript form from the IRS doesnt count as last years tax returns and guess what the tax place only checks there calls once a week and i have to pay to get a copy. This whole time they never told me that!!!And now after all this time of sending paperwork they want a copy of my food stamps. NOT sending that its not their business i put down what i get. My loan is a Farmers loan there for they cant use my husbands income BS if u ask me and one person at chase said he has no rights to the house after we get married thats BS also he has Dower rights i went to college to be a realestate agent my mom is and she even said noway they are wrong. When ever you send paperwork fax it where u can trace it. and any letters with checks u send to it by ceritified mail where chase has to sign for it and keep the copies of the tabs that come off for u to keep and send use your bank ot get a ceritified check that way u can trace who cashes it. At the bottom of paperwork you send put COPY FILED/DATE COPY FILED ATTY/DATE. my aunt told me to do this she said banks hate knowing u filed copies or sent any to a lawyer. Just Breathe and relax thats what i do and enjoy my home while i got it. i cry alot over this but what can you do against a big bank with big deep pockets.

  22. Chase has requested the same documents over and over from me. I have faxed them many times and was told my package was going to underwriting on several ocassions. Now they are threatening me that they will deny my application if I don’t get updated financials in within 14 days. I have to pay my accountant everytime to update the financials. My accountant can’t even believe the hoops we are jumping through and not going anywhere. Class Action Lawsuit? Count me in. Where does one start? Do we let this beast win? I am glad to have found this website, I dont’ feel so alone but I dont’ feel any better seeing all the difficulties that people are having.

  23. Cocked, Locked and ready to Rock ! You wonder why people snap and go “Postal”? Chase ought to be proud of the angst, anguish and ulcers they have caused for the American people. Do they do the same to their European customers that reside in their homeland, doubtful. Maybe they ought to just do business over there…… and sell off our mortgages to American companies that can benefit from the capitalization of the US Federal bailout funds. It’s in the Mortgage companies best interest to get you into a “trial” period…. and then “deny” you. They leverage the Fed bailout subsidies over and over that way. We will never be treated fairly w/o legal representation.

    HAMP is there Hope or is it Hopeless?

    On April 20th, 2010 the Treasury Department released its latest HAMP – Making Home Affordable Program Servicer Performance Report.

    The report shows that more than 1.1 million homeowners have been placed into the HAMP trial payment phase of the plan. Of those only 227,000 have been made permanent.

    The stated goals of the program are to reach 3 -4 million homeowners by the end of 2012. With regards to the trial period it appears that lenders are making some headway. But when it comes to making the modifications permanent many critics complain that lenders are pulling out all the stops to prevent these trial modifications from being etched in stone.

    A quick look at the program might highlight the reasons for the disparity between trial modifications and permanent modifications.

    If one does the math here it could be astounding or revealing – You Decide.

    Imagine a lender decides to send out 150,000 trial modifications at $1,500 a pop = $225,000,000.00

    (this is only an example for illustration purposes)

    The lender decides that this would best be done on loans under 175,000 that are at 6.0% and 30 days delinquent. (monthly payments on these loans is approx. $1,050 per month)

    This means the average loan in this group is approx. $1,050 in arrears multiply this by 150,000 loans = $157,500,000 in arrears

    $225,000,000.00 from Uncle Sam – $157,500,000.00 in arrears = lender is now $67,500,000.00 in the black with no strings attached!!

    It gets better – FOR THE LENDER.

    These lenders do not forgive the arrears- THEY CAPITALIZE THEM = PLUS $157,500,000.00 added to the back end of these loans and back to balance sheet

    $157,000,000.00 + $67,500,000.00 = $225,000,000.00 in the black. THE LENDER has now profited $225,000,000.00 and they haven’t made a single permanent modification.

    And if that’s not enough – HERE ARE THE GINSU KNIVES -

    The lender strings these borrowers along making “trial” payments for 8 months (in direct conflict with HAMP guidelines) the reduced payments at a 2% rate would be $650.00 a reduction in payments of $400 ($1,050 – $650 = $400)

    The “trial” payments are actually forbearance payments, meaning that each month the borrower makes the reduced payment he/she goes into the hole by $400 plus late fees we’ll call that $30 for a total in arrears of $430 per month. Multiply that by the 8 months they are strung along and the borrower is now in arrears at the end of 8 months an additional $3,440. In other words the lender profits by keeping the borrower in the trial period.

    The lender now capitalizes these arrears $3,440 times 150,000 loans = $516,000,000.00 more into the black they go.

    add that to their prior profits —-

    $516,000,000.00 + $225,000,000.00 = $741,000,000.00 ahead of the game BEFORE they have even permanently modified a single loan.

    Now they tell these folks that they don’t qualify for HAMP because of, NPV results, investor guidelines, too much income, too little income and so on. Sometimes they deny these folks with no explanation at all.

    They offer them a traditional in house modification that lowers the rate to 5% and reduces the payment by a minuscule $110 per month but is a lifeline non-the-less that brings them current, let’s them keep their home, and lowers their payment.

    Since these loans are now at a market rate if the borrower makes on-time payments for the next 6 months they can be packaged and sold as “performing” loans in securitized portfolios on the secondary mortgage markets.

    That’s right they can now sell off the portfolio which now has an asset value boosted by capitalized arrears for more than they could have prior to modification.

    OR – they can push the borrower to a short sale under the new (April 15th, 2010) HAFA program where the government will re-imburse them for their loss for being “willing” to sell the property in a short sale. What loss/ loan value do you think they will submit to the government when looking for re-imbursement? The inflated one with capitalized arrears perhaps?

    Is this a win-win?

    The banks love it, and some in the government put lipstick on the pig and claim they have a HAMP and/or HAFA program to “help” distressed borrowers.

  25. OH BOY! That was some fine reading. All the stories are a lot like mine but mine tops them all regarding money. They have already cost me an additional 50 thousand dollars and are at it again for 11K more. I have been fighting with them for months trying to get an answer as to what the $5200.00 is they say we owe out of the clear blue sky. Since April and they still can’t tell me. I have filed numerous complaints with the OCC, VT State Senators and the Attorney General’s Office. WASTE OF TIME. Nobody has any power against Chase and this is why they fleece everyone. I called 5 Lawyers and explained my scenario and got the same answers from each of them. “Chase is a big company and has Teams of Lawyers and a bottomless wallet, you will never win against them” The other thing was “Let them foreclose. Once they start that, a Judge will want to see paperwork to back up all the bullshit. Naturally they can’t provide these documents so you get a free Lawyer basically” I have made mistakes in my 49 years but getting my mortgage with them was the BIGGEST.   26. hi my name is hector and i have the same problem like everybody that is trying to get a loan modification with chase , i have sent paper work for the last year and a half and turn down 3 times for thing that they come up with like your paper work got to us after the date we give you when i had 3 extra days before the date . other things like you did not sign your tax forms when i was never asked before , then i get a number to call and they answer or return your call , my copy machine run out of ink 3 times of me making copies i can go on all day with this but i have thing to do , but yeah CHASE CUSTOMER SERVICE SUCKS! and is to bad that i bank with chase ,

  27. I’ve been trying to get a modification for almost 2 yrs now. The put me on a trial payment plan and at the time said it was for the modification. After a year of making payments they then told me that it was not actually a modified payment I was making and needed to make 3 mths of the new modified payment. Now I’ve made 4 mths of these and still no modification. Every 60 days they need new information updated. By the time the “new” paperwork gets into the system it restarts the clock for them to look at it.. by that time they need the same information again. How are they allowed to do this? I have contacted my states Attorney General and recommend everyone do the same.

  28. BEWARE!!! They denied us a lower interest rate because we didn’t make enough money – duh!

    WE have made payments for over 13 years and never been late at interest rate of 7.89%!

    They never sent the paperwork saying they denied us (third time we sent all the paperwork for refi).

    But other paperwork came that said it was for the HAFA program and needed to be returned in 14 days. Thank GOD it didn’t go through the FAX the first time – it got jammed and I read the cover sheet – which said HAFA-Short Sale and Deed in Lieu of Foreclosure. It made me stop and think, I called Chase and they said oh yes, we are being nice to people and offering this – you’ll get $3000 to rent a place down the street and we get the deed to your place!

    Thank you for the number for the CEO, I called and may be getting somewhere, tomorrow will tell.

  30. I to would join the class action suit. This Oct. it will have been 3 years and 271 pages of info they have asked for again and again. In Jan 10 they told me I qualified for a reduction, in Fl, and for 3 months we made the new monthly payment.
    At the end of the period we get a letter from Az. chase saying we owe 7K in back payments, late fees, etc. We sent the 7K in to them and them all of a suden all the people we were dealing with were either no longer their or would not return any calls. I called them over 100 times and nothing. Now i am in the middle of my 7th application and only God knows where it will end up. No wonder I have high blood pressure.

  33. Hey guys, I posted earlier bout having the baby in september and use losing our house. We received a letter in the mail from Butler and Hotcsh in Orlando, FL(Chases Lawyers). They said for us to re-enstate our house we had to pay $3989. They were supposed to refund two(20 checks that they were holding on to. They said it was to be refunded two(2) weeks ago, the first check just went in today August 26 2011, they keep holding our other check, they really want us to lose the house. Both checks place my wifes whole pay check was supposed to settle this. Keep in mind the 3989 includes next months payment. I was just told by the wife that they were holding one check now it just got difficult. These @$$h01es need to be brought down. They are taking homes from innocent people and noone is doing anything. If anything happens to my child so help me, I will have chases ass till the die I die and each employee that works for them will rot in hell for eternity.

  34. My story is basically the same loss of income bcuz my husband was laid off. We continued making payments on time and for 1 yr after he loss his job draining our savings. We just stop paying in June 2011. We applied several times for modifications to no avail. My husband has since found part time work making way less money. I’ve been practically begging Chase to atleast put us on a trial payment plan to show that we want to make payments and keep our home. They have not agreed to do it thus far, and after reading the comments here I’m glad!! I will never enter an agreement with CHASE that is not reviewed by an attorney and/or judge. Our only hope is to not pay, New York has a law that the Banks must have a conference and work in “good faith”with the homeowner before finalizing a foreclosure. I can see now this is our only hope, to retain a good attorney to accompany us to that conference. Until then I’ll keep building my war chest!

    • I just received my my 1st notice of intent to foreclose on my property. I have an attorney looking over the paperwork and he will file an answer. CHASE didn’t even wait until after the New Year. They served us Dec. 28 2011, couldn’t wait til after New Year’s heartless cowards. They’re even lying and exaggerating in the filing. Stating that they refinanced and consolidated our 2 loans into 1 loan with a lower interest rate. What they did was refinanced our primary loan from a 6.25% to a 5.25% after over a year of fighting and incompetency. They charged an extra 10,000 to the loan to “cover the cost” of refinance and left us with the 2nd loan of 9.34% claiming they couldn’t do anything about it!!! The fight is on, I have all of my paperwork since the day we purchased this house. I’m not going down without a fight. I’m keeping in constant contact with my lawyer to make sure he answer with full knowledge of this. Check with your local Bar assoc. for those who cannot afford assistance they’re are foreclosure prevention programs and they will appoint lawyers to help you pro bono if you cant afford one. They are not going to look for you, you have to search for them, and beware of the SCAMMERS.

  35. i feel so bad that other have been going through something that me and my family went through for 2 yrs it was always your papers are in underwiting or its in the wrong department or you didnt fill out the correct form and you will have to fill out all over again and i think you dont have all the papers, or its just going through the review process. its never the same person and we almost got the approval then they never sent the papers to complete the modification. THEN IT SO HAPPENED i lost my job then they denied us.it was so stressful. We are no longer in our home and its still there empty. it got forclosed. not much u can do little people get lost. :(

I have been paying 3/4 of my mortgage each and every month (mortgage included city, county and school taxes) – Chase has accepted the check BUT keeps sending me notices that I am in imminent danger of foreclosure. I have written numerous letters to Mr. James Dimon, President and CEO of Chase, 270 Park Avenue, New York, NY 10017 – Craig J. Keaney, Senior Vice President of Chase, 3415 Vision Drive, Columbus, OH 43219-6009 – Chase – P.O. Box 44090, Jacksonville, FL32231-4090 stating they are going to forclose on my property – even though my property is in the state of Pennsylvania – Chase – P.O. Box 469030, Glendale, CO 80246 and Chase Fulfillment Center – 4500 Cherry Creek Drive South – Suite 410 – Glendale, CO 80246. I requested and completed a Loan Modification form and faxed to Chase by the due date requested – a Chase representative by the name of Kelly Johnson send me back a letter stating that “the documents you provided were incomplete, mission or late.” This is absolutely incorrect because I am still holding the information faxed. Ms. Johnson stated that she tried to contact me (wrong!) and did not receive any response. I gave my work number and there are only two individuals who answer this number and neither individual stated that a Ms. Johnson did not call asking for me. I am again going to reapply and will continue to do so because this program was set up by President Obama (I had someone tell me that they sent a very professional letter to the President and he had someone in his office help them). I consider myself David and in David and Goliath and I informed Chase that I will NEVER stop fighting for my home. I currently have a credit of less than $500.00 and I am still being threatened with foreclosure! I have never dealt with a mortgage company that is as heartless as Chase. It is extremely sad when hard working Americans are losing their homes and trying to do everyting they can to hold on.
